Are we to become the prey of evil? The „digital storm" and the copyright

Abstract

The essence of copyright can not be degraded in the digital era, but the old legal structures should be replaced by changed tools and new ideas. Neither can the Internet be a „law-free" area, but the law should be enforced here in another way compared to that in reál life. The author examines the new Hungárián copyright draft Act. He con-cludes that a relatíve obsoleteness is seen due to the deficiencies of the particular regulations relat-ing to the Internet as a phenomenon and the defi-ciency of sanctioning of copyright infringem ents. His ideas are based on the international development, and especially on the documents of the European Commission and on somé features of the practice in the USA.
